Appeals
You went to trial and won. Now your opponent has appealed, and you want to preserve your victory. Or you lost at trial, and believe the trial court committed an error by misinterpreting the law, incorrectly instructing the jury, excluding factual or expert opinion evidence that would have been favorable to you, or admitting factual or expert opinion evidence that was unfavorable to you. Regularly, the trial is not the last word in a lawsuit, because someone appeals the result. An appeal is a written request for a higher appellate court or administrative body to modify or reverse the judgment of a lower trial court, appellate court, or administrative agency.
Whether you are the party initiating an appeal to seek a different result or the party resisting the other side’s appeal in order to protect the result you have already obtained, Choquette & Simons LLP can pursue the appeal of your case, whether in state or federal court or an administrative agency. For a combined total of over three decades, we have been involved in all stages of appellate practice and procedure in a variety of substantive legal areas, including: business litigation (breach of contract, business torts – such as fraud and breach of fiduciary duty, and shareholder derivative actions); personal injury; wrongful death; insurance coverage; adverse possession; and education/civil rights matters. We have pursued or defended against appeals in the Colorado Court of Appeals and the intermediate appellate courts of other states, the Colorado Supreme Court and the highest appellate courts of other states, the 10th Federal Circuit Court of Appeals and other federal circuits, and the United States Supreme Court.
We also have experience providing amicus curiae, or “friend of the court,” briefs in both federal and state appellate courts. Such briefs help advance interests or outcomes that are important to our clients in appeals involving parties other than our clients.
